Terms of Service

These terms are the agreement between you and Elivate for using Proposal by Elivate. By creating an account you accept them.

1. Who we are

Proposal by Elivate is operated by Elivate, a sole proprietorship trading in Nigeria. In these terms, "we" and "us" mean Elivate; "you" means the account holder. Contact: code@bokoisaac.pro.

2. Your account

You need an account to use the service. You must be at least 18, give an accurate email address, and keep your sign-in details private. You are responsible for what happens under your account.

One free allocation of credits is granted per person, not per email address. Creating additional accounts to collect repeated free credits is a breach of these terms.

3. Credits and what they cost

The service is metered in credits:

Credits are deducted when a generation starts. If a generation fails through a fault on our side, the credits are returned to your balance automatically. If it succeeds but you dislike the result, the credits are spent, in the same way that printing a page you then discard still uses ink.

Plans

Monthly credits do not roll over. Whatever is unused at the end of a billing period expires when the new allowance is applied.

Prices are in Nigerian naira. Paystack may add its processing fee at checkout, in which case the amount you are charged will be slightly above the price listed, and the exact total is always shown before you confirm.

Fair use on the Team plan

The Team plan is unlimited for normal professional use by the people on your team. It is not intended for automated bulk generation, resale of output as a service, or sharing one team account across an organisation that is not a team. If usage is so far beyond normal that it threatens the service, we may contact you to agree a fair limit. We will always talk to you first.

4. Renewals and cancellation

Paid plans renew automatically each month until cancelled. You can cancel at any time, and cancellation takes effect at the end of the period you have already paid for. You keep access until then. We do not pro-rate part months.

6. Who owns what

Your content

You keep ownership of everything you put in: job posts, notes, portfolio descriptions, and images. You grant us only the permission needed to run the service, which means storing your content and sending it to the AI provider that generates your result.

What the tool generates

The proposals and cover letters generated for you are yours. Use them commercially, edit them, send them, charge for the work they win. We claim no ownership and no royalty.

Two honest caveats. AI output is not always unique: another user with a similar job post may receive something similar, so we cannot promise exclusivity. And the legal position on copyright in AI-generated text is unsettled in many countries, so we cannot guarantee it is protectable as your original work.

Ours

The software, the underlying methodology, the design system, the block catalogue, and the Elivate name and mark remain ours. You may not copy the service, resell access to it, or extract its prompts and methodology to build a competing product.

8. The output is a draft

Everything generated is a draft for you to read, edit, and approve. We do not send anything on your behalf. AI can be confidently wrong, misread a brief, or phrase something in a way you would not. You are responsible for what you send under your own name. Read it first.

9. Availability

We aim to keep the service running but do not promise uninterrupted availability. It depends on third parties, including our AI provider, and any of them can have an outage. We may take the service down for maintenance, and will avoid doing so without warning where we reasonably can.

10. Suspension and closure

We may suspend or close an account that breaches these terms, particularly the honesty and fair use sections. Except where the breach is serious or unlawful, we will contact you first and give you a chance to put it right. If we close your account without cause, we will refund the unused portion of the period you have paid for.

You can close your account at any time by emailing us. Your content is deleted as described in the Privacy Policy.

11. Liability

Nothing in these terms limits liability for death, personal injury, or fraud, and nothing removes rights you have as a consumer that cannot be waived under Nigerian law.

Beyond that: the service is provided as it is. We are not liable for lost profits, lost business, contracts you did not win, or work that did not come in. Our total liability for any claim is limited to what you paid us in the three months before the claim arose.

We say this plainly because it matters: this tool improves how your work is presented. It does not guarantee you will win any job.

12. Changes to these terms

We may update these terms. If a change materially affects you, we will email you at least 14 days before it takes effect. Continuing to use the service after that means you accept the new terms. If you do not, cancel before the date and we will refund the unused part of your period.

13. Governing law

These terms are governed by the laws of the Federal Republic of Nigeria, and the Nigerian courts have jurisdiction. If you are a consumer elsewhere, this does not remove protections you have under your own local law.
